Mr. Arvind Mishra, Chairman of Gagangiri Co-operative Housing Society Ltd., continued to manage the affairs of the society even after the tenure of the Managing Committee expired on 02/06/2023. The committee failed to conduct elections within the stipulated period, and the Deputy Registrar also failed to appoint an Administrator under Section 77A of the Maharashtra Co-operative Societies Act, 1960.

Subsequently, the Chairman, Secretary, and Treasurer were disqualified for a period of five years. As this disqualification order was not challenged by way of revision or appeal under Section 154 from September 2023 to March 2025, the same has attained finality.

Therefore, their continuation in managing the society after expiry of tenure and despite disqualification is without authority of law, and they are liable for action under Section 146(p) of the Maharashtra Co-operative Societies Act, 1960.
