Fees for Maintenance Recovery 154B(29) of MCA 1960

Court Fees Payable (Rule 86 of Maharashtra Co-operative Societies Rules)

As per Rule 86, the society must pay court fee stamp based on the amount

Fee Structure
(A) Amount up to ₹1,00,000
  • ₹100 or
  • 2% of claim amount (Rs.1 to Rs.1,00,000)
    Whichever is higher
(B) Amount from ₹1,00,001 to ₹5,00,000
  • 1% on the amount exceeding ₹1,00,000 (100,001 to 500,000)
  • Maximum limit: ₹6,000
(C) Amount above ₹5,00,000
  • ₹6,000 (fixed for first ₹5 lakh)
  • 0.5% on amount exceeding ₹5,00,00 (500,001 and above but…

Maximum total fee: ₹25,000 per case claimed.

HANDLING CHARGES

Deposit to the Bank in the Department account by challan approved abd given by the Deputy Registrar Office :
  • Up Rs. 1,00,000 = ₹700
  • Rs.50 for next every Rs.1,00,000 or part amount

Other Expenses

  • On Applicaiton Rs. 100/- court fee stamp
  • On Vakalatnama Rs.10 Court Fee Stamp.
  • Postage for issue Notice for hearing
  • Applcation for Adjornment Rs.25 Court fee stamp.

Practical Example

Example 1:

Claim (Recovery) Amount = ₹80,000

  • 2% on Rs.80,000 = ₹1,600
    👉 Pay ₹1,600 (higher than ₹100)
Example 2:

Claim (Recovery) Amount = ₹3,00,000

  • 2 % on  First Rs.1,00,000 = Rs. 2000
  • 1% on Balance Rs.200,000 = ₹2,000
  • Total Payable Rs.2000+ Rs.2000 = Rs.4000
  • You need Pay ₹4,000 
Example 3:

Claim (Recovery) Amount = ₹8,00,000

  • 2 % on  First Rs.1,00,000 = Rs. 2000
  • 1% on Balance Rs.400,000 = Rs 4,000
  • 0.5% on Balance Rs.300000 = Rs 1,500
  • Payable Rs.2000 + Rs.4000+ Rs.1500 = Rs.7500
  • You need Pay ₹7,500 
Mode of Payment
  • The court fee must be paid through Court Fee Stamp
  • It should be affixed on the application filed before the Deputy Registrar
  • Incorrect or insufficient court fee may result in objections or delay
