LIST OF DOCUMENTS FOR RECOVERY PROCEEDING

Documents Required for Initiating Recovery Proceedings Against Maintenance Defaulters

  1. Copy of the Registration Certificate of the Society.
  2. Resolution of the Managing Committee authorising initiation of recovery proceedings against the defaulting member(s), including authorisation in favour of any office bearer to sign, submit applications, and furnish necessary documents before the Deputy Registrar or other competent authority.
  3. Resolution appointing a Legal Consultant/Advocate for conducting and filing the recovery proceedings on behalf of the Society.
  4. Member-wise Ledger Account Statement showing the outstanding maintenance dues of the defaulting member(s).
  5. Copy of the last Maintenance Bill issued to the defaulting member(s).
  6. Court Fee Stamp of Rs.100/- to be affixed on the application, as applicable.
  7. Stamp Duty payable on the amount claimed, calculated as under:
    • Up to Rs.1,00,000/- : 2% of the amount due;
    • Above Rs.1,00,000/- and up to Rs.5,00,000/- : 1% of the amount due;
    • Above Rs.5,00,000/- : 0.50% of the amount due.
  8. Handling Charges payable as under:
    • Rs.700/- where the claim amount is up to Rs.1,00,000/-;
    • Additional Rs.50/- for every additional Rs.1,00,000/- or part thereof, subject to a maximum claim amount of Rs.5,00,000/-.
  9. Copy of the First Demand Notice issued by the Society to the defaulting member(s), along with proof of service/acknowledgement.
  10. Copy of the Second Demand Notice issued by the Society to the defaulting member(s), along with proof of service/acknowledgement.
  11. Copy of the Third Demand Notice issued by the Society to the defaulting member(s), along with proof of service/acknowledgement.
  12. Copy of the Advocate’s Legal Notice issued on behalf of the Society to the defaulting member(s), together with proof of service/acknowledgement.
  13. Copy of the Annual General Meeting Resolution approving the maintenance charges/contributions payable by each member.
  14. Any other documents or information that may be required by the Deputy Registrar, Co-operative Societies, for processing and deciding the recovery application.
